SALES TERMS

THESE TERMS ESTABLISH AN AGREEMENT WITH YOU, AND YOU AGREE TO BE BOUND BY THESE TERMS WHEN YOU ORDER, PAY FOR OR RECEIVE ANY PRODUCT THAT WE SELL OR DISTRIBUTE. NOTE: THESE TERMS INCLUDE A WAIVER OF THE RIGHT TO A JURY TRIAL.

1. Introduction. These Sales Terms (“Terms”) constitute the agreement between you and Great Lakes Potato Chips LLC (“our,” “us,” or “we”) with respect to all products and services that we sell, distribute or otherwise provide (collectively, “Products”).

2. Order Terms. These Terms incorporate the pricing terms, shipping terms and other provisions set forth in any ecommerce webpage, online store, quote, invoice, order confirmation, email or other document that we provide in connection with the Products (collectively, “Order Terms”).

3. Prices and Taxes. The prices for the Products are provided in the Order Terms. All prices are listed and payable in U.S. Dollars. In addition to the prices, you will pay any sales taxes, duties or import/export charges owed to any tax or governmental authority based on our sale of Products to you.

4. Order Processing. We typically process most orders within one to two business days (excluding weekends and holidays), although a delay may occur due to inventory or order volume. We will endeavor to notify you via email of any such delay.

5. Shipment Method and Charges. Unless the Order Terms expressly provide otherwise, we will not ship any Products to California or internationally. Also, unless the Order Terms expressly provide otherwise, with respect to all Products that you order online via our website (including our ecommerce webpages or online store), we will not charge for the cost of shipping such Products to you; provided, however, that the shipping method will be standard, not expedited. With respect to all Products that you order offline, for example, by emailing a purchase order to us, the Order Terms that we provide for the offline order will determine and govern our charges for shipping the Products to you.

6. Risk of Loss. Unless the Order Terms expressly provide otherwise, the entire risk of loss, damage and theft to the ordered Products will pass to you when the carrier first takes possession of the Products for transport to you.

7. Return and Refund Policy. You will have no right, for any reason, to: (a) cancel any order that you have submitted to us for any Product; (b) return any Product to us; or (c) receive any refund of your payment for any Product. If any ordered Product arrives damaged in any way, please email us immediately at info@greatlakespotatochips.com with your order number and a photo of the Product’s condition. Although we have no obligation to provide you with a Product replacement or refund, we may provide a resolution that is satisfactory to you.

9. Miscellaneous. These Terms are incorporated into the Terms of Use, all of which will be binding upon you with respect to the Products that you order from us. WITHOUT LIMITING THE FOREGOING, YOU AGREE TO, AND WILL BE BOUND BY, THE PROVISIONS OF THE TERMS OF USE THAT RELATE TO WARRANTY WAIVER, EXCLUSION OF DAMAGES, MAXIMUM LIABILITY, AND DISPUTE RESOLUTION, INCLUDING, WITHOUT LIMITATION, YOUR ARBITRATION OBLIGATIONS AND WAIVER OF A RIGHT TO TRIAL BY JURY.
